## **Personal Data Protection Notice pursuant to Article 13 of EU Regulation 2016/679**
Please be informed that as of May 25, 2018, the EU Regulation 2016/679 on the protection of individuals concerning the processing of personal data is in force.
The Municipality of Bari explains below how it will use data concerning citizens, including those provided by the citizens themselves, and what rights are recognized by EU Regulation 2016/679.
Personal data, including those attributable to special categories, collected in accordance with specific legal provisions, will be processed by the Municipality of Bari exclusively for the institutional purposes provided by community, national regulations, its own Statute, and municipal regulations adopted in accordance with Article 3 of Legislative Decree No. 267/2000, to provide services or perform functions directly related to such purposes or to ensure compliance with legal obligations.
In some cases, the provision of certain data is optional: in these circumstances, citizens will be specifically informed about the effects of withholding consent for processing.
Personal data will not be disclosed; however, if necessary, they may be communicated to:
- Entities to which the data must be communicated in compliance with an obligation provided by law, regulation, or community legislation, or to comply with a order of the Judicial Authority;
- Subjects designated by the Data Controller, as Data Processors, or to persons authorized to process personal data operating under the direct authority of the controller or processor;
- Other third parties, in cases expressly provided for by law, or if communication becomes necessary for the protection of the Municipality of Bari in judicial proceedings in compliance with current provisions on the protection of personal data.
Personal data are also processed using automated tools for the time strictly necessary to achieve the purposes for which they were collected. The Municipality of Bari implements suitable measures to ensure that personal data are processed appropriately and in accordance with the purposes for which they are managed. It employs suitable security measures, organizational, technical, and physical, to protect information from alteration, destruction, loss, theft, or improper or unlawful use.

The external Deputy Data Processor for personal data processing is Synesthesia, located at Via dell’Artigianato No. 57 – Formigione (Modena).
Personal data collected with specific consent are processed using the following services:
- Online form for information requests. By filling out and submitting the online form, the user consents to the processing of their name, surname, email address, and phone number to receive responses to information requests or any other nature.
- User registration. By filling out and submitting the online form, the user consents to the processing of their name, surname, email address, and phone number to use the Bari Guest Card using the dedicated mobile application.
- Web Analytics Italy is a platform that provides real-time statistics of visitors to Public Administration websites, providing operators with detailed reports. Data is collected and processed by the centralized Web Analytics Italy (WAI) platform. WAI hosts statistical data from the websites of Italian PAs participating in the project. WAI helps administrations understand the online behavior of users, with the aim of providing citizens with increasingly effective and inclusive websites and services. Citizens have the right, at any time, to obtain confirmation of the existence or not of the same data and/or to verify its use. They also have the right to request, in the forms provided by the regulations, the correction of inaccurate personal data and the integration of incomplete data; in cases indicated by the regulation, subject to the special discipline provided for some treatments, they may also request the deletion of data, after the specified storage period, or the limitation of processing; opposition to processing, for reasons related to their particular situation, is allowed unless there are legitimate reasons for the continuation of processing.
